Lawyers file an appeal to keep Evolution accuser anonymous

Calcagni and Kanefsky filed an emergency application following a court order that allowed the name of the author of a negative report into Evolution to be removed.


A long-running legal struggle over a 2021 report accusing Evolution, the biggest gaming corporation, of marketing its services in other areas and employing misleading practices has gained substantial traction.

Last week, Evolution took a step closer to identifying the organization or entities responsible for the negative report from 2021.

The study, whose author remains nameless for the time being, accused Evolution of deceitful practices. In addition to these allegations, the firm was accused of operating in a variety of markets.


The devastating research caused a 36% drop in Evolution’s share price, implying a market loss of at least $10 billion. Not surprisingly, the corporation denied the charges, claiming that they were made with the intention of harming its business.

A court judgment last week accelerated the legal process by ordering the disclosure of the report’s authors. This was a watershed moment in the legal fight between Evolution and Calcagni & Kanefsky (C&K), a law firm that represents the anonymous report’s authors.

However, C&K moved to the New Jersey Superior Court, where they filed an emergency request seeking a stay on the recent decision requiring the name of the 2021 report author to be disclosed.

The attorneys at C&K wrote in the most recent motion to dismiss: “(C&K) will suffer substantial, immediate and irreparable harm absent a stay because (i) it will be forced to disclose confidential client information, a disclosure that cannot be undone; and (ii) disclosure of the identities of the investigative firm and its client will moot (C&K’s) appeal of the February 28 Order, thus insulating that ruling from appellate review.

The appeal may help keep the concealed identity of the author of the report

Prior to the current submission, Evolution’s defense would have learned the identities of the entities responsible for the 2021 report into the corporation by Friday, March 7, 2025. However, C&K’s recent action complicates the situation and may eventually assist obscure the name of the entity behind the damning report.

In any event, C&K’s new step is not surprising, and it is consistent with other actions taken in 2022. At the time, a court ordered that the identity of the entities behind the 2021 Evolution study be published, prompting the law firm to seek an appeal, which was eventually settled in its favor, preserving the anonymity of the companies that created the research.
